A Bartlesville man is behind bars after deputies say he assaulted his wife after a night of heavy drinking and she won the battle.

32-year-old Derrick Maynard was arrested for aggravated assault on a family with a weapon and threats to kill, a felony charge.

Washington County deputies say they responded to home on Elm in Bartlesville Monday night around 10:00.

Deputies say Mansard's wife told them the two started drinking whiskey around 2:30 or 3:00 that afternoon. She said later in the day, he became highly intoxicated and began hurling obscenities at her.

But it wasn't just words. She told officials Maynard threw a Nintendo Wii remote at her. According to the affidavit, she said she put him to bed but he got up a short time later. When he returned, she reported that he again yelled obscenities at her and verbally abused her saying she "needed to go kill herself" and that she "did not deserve to live".

At that point, the report states that he grabbed an oil heater and threw it at her. Officials report she then said that he picked up a pellet rifle and pointed at her head saying "you deserve to die" and pulled the trigger. The pellet rifle wasn't loaded, according to the report.

That's when she told officials that he jumped on top of her and began punching her with his fists. She said she curled up into a ball and starting kicking him, in an attempt to get him off of her.

The report says she believes she connected with his nose and lip and may have bloodied them. She also stated that his black eyes visible in his mug shot were from him beating his head on doors and walls during an earlier intoxicated rampage.

Deputies on the scene say Maynard appeared highly intoxicated and his speech was not comprehensible and was unable to stand or sit up straight. He was arrested and faces aggravated assault on a family with a weapon and a felony charge of making threats to kill.
