Governor Fallin issues statement on Dusten Brown

OKLAHOMA CITY -

Governor Mary Fallin says she will review South Carolina's request for rendition of Dusten Brown to South Carolina.

The Governor said on Tuesday that she has spoken with South Carolina Governor Nikki Haley about the case of Brown, "Baby Veronica's" biological father. Brown is the biological father of Veronica and is currently battling with her adoptive family for custody.

Baby Veronica was born in Oklahoma but her parents gave her up for adoption after she was born. She was adopted by the Capobiancos, a family in South Carolina.

In June, the United States Supreme Court ruled Veronica was to be returned to her adoptive parents.

On Tuesday, Governor Haley signed an extradition order for Brown, who is a member of the Cherokee Nation in Oklahoma, ordering the extradition of Brown to South Carolina. Brown is to face felony custodial interference charges after he refused to take 3-year-old Veronica to South Carolina to be reunited with her family.

On Monday, he turned himself into Sequoyah County officials but refused extradition and quickly bonded out.

When Governor Haley sent her extradition warrant to Governor Mary Fallin, the Oklahoma Governor said she would not act before a September 12 hearing in Oklahoma on the case. Governor Fallin said she believes that Mr. Brown should have the opportunity to argue his case in a court of law and will not act on the rendition order before that date.

She issued the following statement regarding the case:

"As a mother, my heart goes out to Veronica, who has been placed in a terrible situation. I can also imagine the pain that both her adopted and biological parents are feeling.

"As governor, my job is to ensure the law is upheld. My legal staff and I are currently reviewing the request for rendition of Mr. Brown to South Carolina. Should that request adhere to the letter and spirit of the law, I will sign it. My hope, however, continues to be that sending Mr. Brown to face criminal charges in South Carolina is unnecessary.

"To be clear, the legal system cannot deliver a happy ending in this case. Only Mr. Brown and the Capobianco family can do that. For Veronica's sake, I urge them to reconcile and to come to an agreement that best serves their child and grants all parties some measure of peace."
