Jerome Ersland Rally


An Oklahoma City case that gripped the Nation makes some progress.


In 2009, Pharmacist Jerome Ersland shot and killed a would-be robber inside Reliable Pharmacy. Prosecutors say Ersland's first shot was justified, but he went too far when he shot the teenage victim at point-blank range, after walking out of the pharmacy. He's currently behind bars for life, but today, Ersland's supporters rallied after his new attorney started the process of appealing his conviction. Earlier this month, Attorney Doug Friesen filed a brief in the case, asking for a new trial. Supporters believe Ersland's side of the story was not heard during his first trial, so they want another one. "There was absolutely nothing on Jerome's side of the story that was ever told," says Friesen. Fox 25's Kisha Henry was there as those who agree gathered at the Oklahoma City Farmer's Market.


"It's just taken so long to get the research, and get the previous case, and all the transcripts, and go through them, and find out where the mistakes were made," says Senator Ralph Shorty, (R)- Oklahoma City.


"They were working, but they couldn't see themselves going anywhere at that particular point," adds Friesen, referring to Ersland's supporters, who he says have been a huge support in the case. Now, he says that hard work is starting to show. "Hey, we're doing something! Our work is showing some fruit here."


Supporters say today's rally is a celebration of that fruit, and to show support for the man who sits behind bars. "I committed to Jerome Ersland the day after he was convicted; I would spend my entire career, if necessary, to make sure that he was out," says Sen. Shortey.


"This cause has caught the heartstrings of a lot of people," says Friesen. According to Friesen, that support even comes from some of the guards in prison. "They just looked at me and said, 'Good luck. This man doesn't belong here.'"


"I just want to still show support," says Karen Monahan, organizer of the rally. She says she anticipated hundreds at the event, and though only around 35 people showed up, she says the support behind Ersland is now bigger than ever.


"We've got over 34,000 signatures, and to me, that just speaks volumes," says Monahan.


"People ask me all the time, 'What are my rights? How far can I go? What if I go too far? When you're attacked, you should never have to think-- if I respond, am I going to have to go to prison?" says Sen. Shortey. He and other supporters say the rally was not just about one man, but all others who choose to protect themselves in the future. "We're not going to back down. We need everyone to know that."


At the rally, information was available for folks on Friesen's Second Amendment Protection Plan, which was created because of this cause. Under the plan, participants can pay an annual $119 to protect themselves, in case they have to defend themselves. Under the plan, Friesen is on-call 24/7 for any gun-related incident. It also includes self-incrimination prevention, meaning you won't have to speak with police. It also includes trial prevention services, full legal representation up to charges filed, direct email access so Friesen can answer any legal questions concerning the Second Amendment, and one-free hour of legal consultation on any subject. Friesen filed the brief October 1. He says he's now waiting for the Attorney General to respond to the brief, which he expects within the next 60 to 90 days.


"I don't blame the jury for finding him guilty. I think, under the instructions that they had, they absolutey had to because they had nothing that would counter the state's case," says Friesen. He hopes to get a chance at a second trial, in which his client's voice will be heard.

Search continues in creek for missing Okla. teen

KINGFISHER, Okla. (AP) -- Authorities continue to search for a Kingfisher teenager who disappeared after jumping into Uncle John Creek.

Police say 17-year-old Taylor Faine jumped into the creek Thursday and did not resurface. Kingfisher Fire Chief Randy Poindexter told The Oklahoman (http://bit.ly/10s2oB6 ) on Saturday that manmade dams have been built in hopes of finding Faine's body.

Authorities say Faine was swimming with friends in an area where no swimming signs are in place because of dangerous currents in the creek.
