Okla. House panel OKs dual-service exemption
OKLAHOMA CITY (AP) -- Oklahoma public officials activated for military service could not be removed from office under a proposal that has cleared a House panel.
The House Rules Committee on Wednesday approved a resolution by Hominy Republican Sean Roberts that would send the issue to a vote of the people in November.
Roberts introduced the resolution after the attorney general's office ruled last year that District Attorney Rex Duncan had vacated his job when he was mobilized by the Oklahoma National Guard to serve in Afghanistan. Attorney General Scott Pruitt cited a provision in the constitution that prohibits public officials from holding two offices.
Roberts' measure would ask the people to amend the constitution to carve out an exemption for military personnel who are activated. It now heads to the full House.
