Court upholds same-sex divorce ruling

OKLAHOMA CITY (AP) -- An Oklahoma appeals court has upheld the dismissal of a lawsuit that sought a divorce between two women who claimed they obtained a marriage license in Canada.
A three-judge panel of the Oklahoma Court of Civil Appeals unanimously upheld a Tulsa County judge's ruling dismissing the petition in 2008.
The appellate court's decision says the judge was correct to throw out the lawsuit. It says the women did not produce evidence of their marriage and that Oklahoma courts do not have jurisdiction to grant divorces between members of the same sex.
Cait O'Darling had sought the divorce. O'Darling claimed she was denied due process rights and should have been allowed to present evidence on the legality of her foreign marriage.
